Constitution

  1. Name

The club will be called “ The Ainsdale Club”

  1. Aims and Objectives

The aims and objectives of the club will be;

  • To offer coaching and competitive opportunities in association football, crown green bowls, cricket, darts, pool, skittles and any other sports promoted by the club committee
  • To promote the club and its sports within the local community
  • To manage the club premises and land
  • To ensure a duty of care to all members of the club
  • To provide all its services in a way that is fair to everyone
  1. Membership
  2. Membership of the club is open to anyone interested in promoting, coaching, volunteering or participating in all the club’s sports and activities regardless of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs
  3. The membership shall consist of the following categories
  • Full member: playing and non playing members aged 18 and over
  • Junior member: under 18
  • Student member: 18 and over in full time education or training
  • Life member
  1. All members will be subject to the regulations of the constitution and by joining the club shall be deemed to accept these regulations and codes of practice that the club has adopted
  2. Individuals shall be eligible to take part in the business of the Club, vote at general meetings or be eligible for selection in any club team so long as the applicable subscription has been paid by the due date and/ or membership has been agreed by the Club committee. Junior members may not vote at general meetings.
  3. The secretary shall maintain a register of members containing name, address ( postal or email) telephone number and date of birth ( juniors only)
  4. Membership Fees

Membership fees must be paid by the following dates;

Cricket and bowls     31st May

Football                      30th September

All others                    31st May

If a subscription is not paid by the above date the member shall cease to be a member of the club and must reapply to become a member.

Subscriptions must be paid as follows;

Cricket , football and bowls  –  to the treasurer of the section

All others                                  –  to the designated premises supervisor

The secretary of each section must keep a register of the name, address ( postal or email) telephone number ( with date of birth for any junior member)

The secretary of each section must deliver to the club treasurer by 14th June ( cricket and bowls) or 14th October (football) the list of members and payment of their membership fees.

In any event the treasurer of each section must pay to the club treasurer by the same dates the following sums

Cricket      £1500

Bowls        £4000

Football    £3000

The amount of the payment on account may be varied at any time by the committee

If the list of members is not delivered or payment not made on the due date the team games for that section shall not be permitted to take place

The designated premises supervisor must by 31st May display a notice prominently in the club containing a list of all members other than cricket, bowls and football. New members must be added to the list.

Upon payment of the relevant membership fee the details of the member shall be entered on the register of members and a membership card will be given to the member

 

  1. Sports Equity
  2. This club is committed to ensuring that equity is incorporated across all aspects of its development. In doing so it acknowledges and adopts the following Sport England definition of sports equity

              “ Sports equity is about fairness in sport, equality of access, recognising inequalities and         taking steps to address them. It is about changing the culture and structure of sport to ensure it   becomes equal to everyone in society”

  1. The Club respects the rights, dignity and worth of every person and will treat everyone equally within the context of their sport, regardless of age, ability, gender ,race, ethnicity, religious belief, sexuality or social/ economic status.
  2. The Club is committed to everyone having the right to enjoy their sport in an environment free from threat of intimidation, harassment and abuse
  3. All club members have responsibility to oppose discriminatory behaviour and promote equality of opportunity
  4. The Club will deal with any instance of discriminatory behaviour seriously, according to club disciplinary procedures
  5. Safeguarding Children

The Club is fully committed to safeguarding the wellbeing of its members. Every individual in the Club should, at all times, show respect and understanding for their rights, safety and welfare, and conduct themselves in a way that reflects the principles of the Club and the guidelines provided by our sports’ governing bodies and contained in the Code of Ethics and Good Practice for Children’s Sport

  1. Officers

The officers of the Club will be the President, Chair, Secretary and Treasurer

Officers will be elected annually at the AGM ( save for the President which is a lifetime appointment)

  1. Trustees

The property of the Club shall be vested in three trustees who shall be elected at the AGM as vacancies may occur by way of resignation or death

  2. The affairs of the Club shall be conducted by a committee which shall consist of

President

Chair

Secretary

Treasurer

Football Representative

Bowls Representative

Cricket Representative

Other members Representative

Designated Premises Supervisor

  1. All committee members must be members of the Club
  2. The term of office shall be one year and members shall be eligible for re-election
  3. If the post of an officer or ordinary committee member should fall vacant after such an election, the committee shall have the power to fill the vacancy until the succeeding AGM
  4. The committee will be responsible for adopting new policy, codes of practice and rules that affect the organisation of the Club
  5. The committee will have power to appoint advisors to the committee as necessary to fulfil its business
  6. The committee will be responsible for disciplinary hearings of members who infringe the club rules/ regulations/ constitution. The committee will be responsible for taking any action of suspension or discipline following such hearings.
  7. The committee meetings will be convened by the Secretary and be held no less than 6 times per year
  8. Only the posts listed above shall have the right to vote at committee meetings.
  9. The quorum required for business to be agreed at committee meetings shall be four

 

  1. Finances
  2. The club Treasurer will be responsible for the finances of the Club
  3. The financial year of the Club will run from 1st January to 31st December
  4. All club monies will be banked in an account held in the name of the Club
  5. An audited statement of annual accounts will be presented by the Treasurer at the AGM
  6. Any cheques drawn against club funds should hold the signatures of the Treasurer plus one other officer
  7. All members of the Club shall be jointly and severally responsible for the financial liabilities of the Club
  8. Annual General Meetings and Extraordinary Meetings
  9. General meetings are the means whereby the members of the Club exercise their democratic rights in conducting the Club’s affairs.
  10. The Club shall hold the AGM in the month of March to
  • Approve the minutes of the previous year’s AGM
  • Receive reports from the President and Chair
  • Receive a report from the Treasurer and approve the annual accounts
  • Elect the officers and committee
  • Agree the membership fees for the following year
  • Consider any proposed changes to the Constitution
  • Deal with any other relevant business
  1. Notice of the AGM shall be given by the Club Secretary with at least 14 days notice to be given to all members
  2. Nominations for officers and members of the committee shall be sent to the secretary prior to the AGM
  3. Any proposal to change the Constitution or any other proposal shall be sent to the Secretary no less than 7 days before the AGM. The Secretary will inform the members of any proposals no less than 5 days before the AGM
  4. All members save junior members have the right to vote at general meetings
  5. The quorum for a general meeting shall be 20
  6. The Chair shall hold a deliberative as well as a casting vote at general and committee meetings
  7. An extraordinary general meeting (EGM) shall be called by an application in writing to the Secretary supported by at least 50 signatures of members of the Club. The committee shall also have power to call an EGM by decision of a simple majority of the Committee
  8. All procedures for EGMs shall be the same as for AGMs
  9. Amendments to the Constitution

The constitution will only be changed by majority vote at an AGM or EGM

  1. Discipline and Appeals
  2. All complaints regarding the behaviour of members should be presented and submitted in writing to the Secretary
  3. The Committee will meet to hear complaints within 7 days of a complaint being lodged. The committee has the power to take appropriate disciplinary action including the termination of membership
  4. The outcome of a disciplinary hearing should be notified in writing to the person who lodged the complaint and the member against whom the complaint was made within 3 days of the hearing.
  5. There will be the right of appeal to the Committee comprising different members following disciplinary action being announced. Notice of appeal must be received by the Secretary by 7 days from the decision being received. The committee must consider the appeal within 7 days of the Secretary receiving notice of appeal
  6. Dissolution
  7. A resolution to dissolve the Club can only be passed at an AGM or EGM by a simple majority vote of the membership
  8. In the event of dissolution, all debts must be paid from Club funds. Any assets that remain will become the property of another Club with similar objectives or the Governing Bodies of each of the sports played at the Club. The members shall have the right to choose the destination of the funds.
